But, if you earn wages as an employee or have self-employment income while working in a foreign country as an ex-patriate or expat, you might be able to use the foreign earned income exclusion to exclude up to $130,000 (for the 2025 tax year) as tax-free income (or 2 x $130,000 or $260,000 if married to another foreign income earner). (<a class=\"broken_link\" href=\"https:\/\/www.wcginc.com\/kb\/index.php?View=entry&amp;EntryID=34\">earned income definition<\/a>)<\/li>\n<li>You must satisfy one of the following (a, b\u00a0<strong>or\u00a0<\/strong>c) \u2013\n<ul>\n<li>a. United States citizen who is a\u00a0<strong>bona fide resident<\/strong>\u00a0of a foreign country or countries for an uninterrupted period that includes an entire tax year. Or,<\/li>\n<li>b. United States citizen or resident alien who is\u00a0<strong>physically present<\/strong>\u00a0in a foreign country or countries for at least 330 full days during any period of 12 consecutive months. Or,<\/li>\n<li>c. United States resident alien who is a citizen or national of a country with which the United States has an income tax treaty in effect and who is a bona fide resident of a foreign country or countries for an uninterrupted period that includes an entire tax year.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p>You must satisfy\u00a0all\u00a0three parts above (1, 2\u00a0<strong>and<\/strong>\u00a03).\u00a0 If you are married to another foreign income earner, you both do not have to meet the same test of a, b or c above. You could be a resident while your spouse qualifies as physically present.<\/p>\n<p>Some people are simply not eligible for the foreign income exclusion. For example, US government employees paid by the US government cannot claim the exclusion. This usually involves extensive tax treaty research, overnight mailings, Power of Attorney documentation and a slew of special handling to ensure your tax consequence is correctly handled.<\/p>\n<p>For our foreign owners of C corporations, additional time is necessary for possible back-up withholdings,\u00a0<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f5472.pdf\" target=\"_blank\" rel=\"noopener\">Form 5472<\/a>,\u00a0<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8233.pdf\" target=\"_blank\" rel=\"noopener\">Form 8233<\/a>, W-8 BEN and tax treaties, among other issues that need special handling. In these situations our tax preparation fee will be at least $2,500 for any C corporation owned by foreign investors or owners. Our fee for the FBAR filing is\u00a0<strong>$350 which includes up to 5 accounts<\/strong>.\u00a0The FBAR is electronically submitted to the Financial Crimes Enforcement Network, a division of the U.S. Treasury Department (who also oversees the IRS).<\/p>\n<p>According to a nice\u00a0<a href=\"https:\/\/www.irs.gov\/businesses\/comparison-of-form-8938-and-fbar-requirements\" target=\"_blank\" rel=\"noopener\">FBAR 8938 table on the IRS website<\/a>, an FBAR is required when the \u201caggregate value of financial accounts exceeds $10,000 at any time during the calendar year. If you are unmarried (filing as a single) and you have foreign assets exceeding $200,000 on the last day of the year or $300,000 anytime throughout the year, or $400,000 and $600,000 respectively for married taxpayers, you are usually required to file Form 8938.<\/p>\n<p>If you do not qualify as an expat, Form 8938 is still required for joint filers if you have foreign assets exceeding $100,000 on the last day of the year or $150,000 anytime throughout the year.
